DaysLive — Terms of Service

DaysLive is operated by Ehsaan Abdul Sami, an individual operator based in India. DaysLive is not currently represented in these Terms as an incorporated company or other registered legal entity.

When contacting us about a particular profile, content item, or transaction, please provide the relevant DaysLive URL or transaction details where applicable.

You must be at least 18 years old to create an account or make a monetary contribution through the Service.

DaysLive does not knowingly permit a person under 18 to create an account or make a contribution.

A birthday profile may relate to a person who is under 18. If you submit information, photographs, or other content concerning another person, including a person under 18, you represent that you have the necessary authority or permission to submit that material and for it to be displayed through the Service.

You are responsible for complying with the laws that apply to you when using the Service.

DaysLive is an entertainment and social-ranking platform centered on birthday profiles and dates.

Users may create or participate in birthday profiles and may make monetary contributions associated with a profile. Contributions may affect the displayed contribution total and ranking associated with that profile.

A contribution is a payment made in connection with participation in the DaysLive experience and associated platform features. It is not an investment, security, charitable donation, ownership interest, or promise of a financial return.

Unless DaysLive expressly states otherwise, contributors do not acquire ownership, equity, voting rights, intellectual-property rights, or any other ownership interest in DaysLive or in a birthday profile.

A contribution does not guarantee a particular ranking, position, visibility, outcome, recognition, or financial return.

DaysLive does not award a monetary prize to contributors merely because they make a contribution or because a profile reaches a particular ranking, unless a separate promotion expressly states otherwise and is governed by its applicable terms.

DaysLive may provide public birthday pages, profiles, rankings, search, account features, contribution features, and other functionality. Features may be changed, added, limited, suspended, or removed at any time.

We aim to keep the Service available and functional, but we do not guarantee uninterrupted, error-free, secure, or continuous availability. The Service may be unavailable or limited because of maintenance, updates, technical failures, third-party outages, security measures, or circumstances beyond our reasonable control.

Some features require an account. You are responsible for providing accurate information and keeping your login credentials and devices secure.

You are responsible for activity performed through your account unless you promptly report unauthorized access to us. We may suspend or restrict an account where reasonably necessary to protect the Service, users, payment systems, or legal compliance.

You may submit information, images, usernames, descriptions, and other material to the Service (“User Content”). You remain responsible for your User Content and must have the necessary rights, permissions, consents, or other lawful basis required to submit it.

If you submit content concerning another identifiable person, you represent that you have the authority or permission necessary to submit that content and for DaysLive to display it for the purposes of the Service.

You must not submit content that is unlawful, fraudulent, deceptive, defamatory, abusive, invasive of another person’s privacy, infringing of intellectual-property or other rights, or otherwise prohibited by these Terms.

By submitting User Content, you grant DaysLive a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, format, and use that content as reasonably necessary to operate, maintain, secure, promote, and improve the Service.

This license does not transfer ownership of your User Content to DaysLive.

We may remove, restrict, disable, or preserve User Content when reasonably necessary for safety, legal compliance, rights protection, investigation, dispute resolution, or operation of the Service.

Information submitted for a public birthday profile or ranking may be visible to other users and may be accessible through public pages, search engines, links, or other internet services.

Do not publish information about another person unless you have an appropriate legal basis or permission to do so.

You should carefully consider whether a person's name, photograph, birthday information, social-media username, or other identifying information should be made public. DaysLive does not require users to publish information that they do not have the right or appropriate authority to publish.

If you believe that content displayed on DaysLive violates your privacy, publicity, intellectual-property, personal rights, or other legal rights, you may contact us at ehsaan.suhail20@gmail.com.

Please provide, where applicable:

• the relevant DaysLive URL;
• a description of the content at issue;
• the basis for your request;
• information reasonably sufficient to verify the request; and
• any other information needed for us to assess the matter.

We may remove, restrict, disable, or preserve content while investigating a complaint or where required or reasonably necessary for legal compliance, safety, rights protection, or dispute resolution.

Submitting a complaint does not guarantee removal. We may request additional information before taking action.

Certain features allow users to make monetary contributions associated with a birthday profile.

The contribution amount and any applicable limits will be displayed by the Service at or before checkout. DaysLive's systems determine the amount applicable to a transaction.

Payments are processed through third-party payment providers, including PayPal. Your use of a payment provider may also be subject to that provider's separate terms, policies, verification procedures, dispute procedures, and applicable payment rules.

A payment is not considered successfully completed merely because a user reaches a checkout or approval screen. DaysLive may wait for payment-provider confirmation and its server-side settlement process before treating a contribution as successful.

Except where a refund, reversal, chargeback, dispute remedy, or other remedy is required by applicable law or is available under applicable payment-provider rules, successfully processed contributions are non-refundable.

In particular, DaysLive generally does not provide voluntary refunds for change of mind, incorrect recipient selection, or an amount entered incorrectly by the contributor.

This policy does not exclude or limit rights that cannot lawfully be excluded or limited, including rights relating to unauthorized transactions, duplicate or erroneous charges, payment-provider reversals, disputes, chargebacks, or circumstances in which a refund or other remedy is required or available under applicable law or payment-provider rules.

You should review the relevant birthday profile and contribution amount carefully before confirming payment.

Any refund decision will be made in accordance with these Terms, applicable law, and the applicable payment provider's rules.

If you believe a payment was unauthorized, duplicated, incorrectly processed, or otherwise requires review, contact us promptly at ehsaan.suhail20@gmail.com with the relevant transaction details.

If you believe a transaction was made without your authorization or was processed incorrectly, notify us as soon as possible. We may investigate the transaction and coordinate with the applicable payment provider.

A contribution may be reversed, refunded, removed from a ranking, or otherwise adjusted where required because of a payment failure, reversal, refund, fraud review, chargeback, dispute, duplicate transaction, provider action, legal requirement, or other legitimate payment-processing event.

DaysLive does not guarantee the outcome of a dispute or payment-provider claim. You may also have rights or remedies directly against the applicable payment provider under its terms and policies.

Rankings are generated from transaction and contribution data recognized by DaysLive's systems.

Rankings may change as transactions are processed, reversed, refunded, disputed, or otherwise updated. DaysLive may correct rankings, contribution totals, or related displays when necessary to reflect valid transaction status.

A contribution does not guarantee a particular ranking or position and does not create any right to remain ranked for a particular period.

DaysLive may temporarily withhold, remove, or correct a contribution or ranking where a transaction is under review or where doing so is reasonably necessary for fraud prevention, payment reconciliation, legal compliance, or correction of an error.

You must not:

• use the Service for unlawful, fraudulent, deceptive, or abusive purposes;
• interfere with or attempt to compromise the Service or its security;
• access accounts, data, or systems without authorization;
• manipulate rankings, contribution totals, or payment records through technical or deceptive means;
• submit content that violates another person's rights;
• impersonate another person or misrepresent your authority to submit a profile or content;
• use automated means to abuse, overload, scrape, or circumvent reasonable Service restrictions;
• use stolen, unauthorized, or fraudulent payment credentials; or
• use the Service in a way that violates applicable law or third-party payment-provider rules.

You must take reasonable steps to protect your account credentials and devices. If you believe your account has been compromised, contact us promptly.

We may take protective measures, including restricting access or transactions, where we reasonably believe an account or transaction presents a security, fraud, abuse, or compliance risk.

You may stop using the Service at any time. We may suspend, restrict, or terminate access where reasonably necessary because of a violation of these Terms, security concerns, suspected fraud or abuse, legal requirements, payment issues, or operational reasons.

Termination does not automatically create a right to a refund of contributions that were validly processed and are otherwise non-refundable under these Terms.

Closing an account or deleting a profile does not necessarily result in deletion of transaction records or other information that DaysLive is required or permitted to retain for legal, accounting, security, fraud-prevention, dispute-resolution, payment-processing, or other legitimate purposes.

The DaysLive name, branding, software, design, interfaces, and other Service materials are owned by or licensed to the operator unless otherwise stated. Except as permitted by law or expressly authorized by us, you may not copy, modify, distribute, sell, reverse engineer, or exploit those materials.

You retain ownership of User Content to the extent you own it, subject to the license granted in these Terms.

The Service may depend on third-party services, including payment, hosting, authentication, analytics, and other providers. Third-party services may have their own terms and privacy policies.

Payments may be processed through PayPal or another payment provider expressly presented by DaysLive. Your relationship with the applicable payment provider is also governed by its terms and policies.

DaysLive is not responsible for independent failures or policies of third-party services, although we may assist with issues relating to transactions processed through them where reasonably possible.

We may change, suspend, or discontinue features of the Service. We may also update these Terms when reasonably necessary.

When material changes are made, the updated Terms will be posted on the Service with a revised “Last Updated” date. Your continued use of the Service after an update takes effect constitutes acceptance of the updated Terms to the extent permitted by law.

The version of these Terms in effect at the time of a transaction will generally govern that transaction, subject to applicable law and any terms that expressly apply to the transaction.

Our handling of personal information is described in the DaysLive Privacy Policy. Personal information may include account information, profile information, User Content, transaction-related information, security information, and other information processed in connection with the Service.

DaysLive will process personal information in accordance with its Privacy Policy and applicable data-protection and privacy laws.

Nothing in these Terms is intended to limit a data subject's mandatory privacy or data-protection rights.

Information may be retained after account closure or profile deletion where reasonably necessary or legally required for payment records, accounting, fraud prevention, security, legal claims, dispute resolution, compliance, or other permitted purposes.

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis. We do not guarantee the accuracy, availability, suitability, reliability, or uninterrupted operation of the Service, rankings, profiles, or User Content.

We do not guarantee that any contribution will result in a particular ranking, outcome, recognition, visibility, or other result.

Nothing in these Terms excludes or limits any warranty, right, or remedy that cannot lawfully be excluded or limited.

To the maximum extent permitted by applicable law, DaysLive and its operator will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or related to use of the Service.

Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot legally be excluded or limited.

Any liability limitation or cap will apply only to the extent permitted by applicable law.

To the extent permitted by applicable law, you agree to be responsible for losses, claims, liabilities, damages, and reasonable costs arising from your unlawful use of the Service, your violation of these Terms, or your User Content, to the extent your conduct caused the relevant claim or loss.

These Terms are governed by the laws of India, subject to any mandatory consumer, privacy, payment, or other rights that apply to you and cannot lawfully be excluded.

Subject to mandatory rights and remedies that cannot lawfully be restricted, disputes arising from or relating to these Terms or the Service will be subject to the jurisdiction of the competent courts in India having jurisdiction over the operator's principal place of residence or business.

Nothing in this section prevents a user from exercising mandatory statutory rights or remedies that cannot lawfully be waived or restricted.

If any provision of these Terms is found to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law and the remaining provisions will continue to apply.

These Terms, together with the DaysLive Privacy Policy, Refund Policy, and any other policies expressly incorporated into them, constitute the agreement between you and the operator concerning your use of the Service, subject to any mandatory rights or obligations imposed by applicable law.
